Turistta Platform Release & Waiver

1. Assumption of Risk

By booking and participating in any experience through Turistta, you acknowledge that you fully assume and accept all risks associated with travel and recreational activities. You understand these activities may involve physical exertion, exposure to the elements, and inherent dangers including but not limited to falls, fractures, head injuries, sprains, contusions, and general bodily injury. You voluntarily accept these risks.

2. Release of Liability & Indemnification

You hereby release and hold harmless Turistta, operator Jonathan Guzman, and all associated parties from any and all claims, damages, liability, or causes of action arising from your participation in any experience, including but not limited to personal injury, death, or property damage. This release applies to claims arising from ordinary negligence. However, this release does NOT apply to gross negligence, willful misconduct, or reckless behavior by the operator.

You further agree to indemnify and hold harmless Turistta and operator Jonathan Guzman from any third-party claims, damages, or legal proceedings arising from your participation in this experience.

3. Medical Declaration

You certify that you are in good physical health and capable of participating in your chosen experience. You agree to immediately disclose any medical conditions or medications that may affect your ability to safely participate. Turistta is not responsible for medical emergencies or complications related to pre-existing conditions.

4. Safety Compliance

You agree to follow all safety instructions provided by Turistta operators and to comply with all local laws and regulations. Failure to follow safety guidelines may result in immediate termination of your experience without refund.

5. Photo and Video Release

You grant Turistta permission to photograph or video record your participation and to use these images for marketing purposes. If you do not wish to be recorded, please notify your operator in advance.

6. Acknowledgment

By proceeding with your booking, you acknowledge that you have read and fully understand this agreement and voluntarily agree to its terms and conditions.
